Introduction

These Terms and Conditions (“Terms”) govern the relationship between the Animal Rescue Organisation (“Organisation”, “we”, “us”, “our”) and adopters, volunteers, donors, and any individuals or entities engaging with the Organisation. By adopting, surrendering, volunteering, donating, or purchasing goods or services from the Organisation, you (“you”, “your”, “participant”) agree to comply with these Terms. Our mission is to rescue, rehabilitate, and rehome small animals and wildlife, while providing a safe, respectful environment for all.

Definitions
  • Adopter: An individual or entity who adopts an animal from the Organisation.

  • Volunteer: An individual who offers time or skills to assist the Organisation without financial compensation.

  • Donor: An individual or entity who provides monetary or in-kind support to the Organisation.

  • Surrender: The act of giving up ownership of an animal to the Organisation.

  • Goods and Services: Products and/or services provided by the Organisation for sale or donation.

  • Lifetime Return Policy: The Organisation’s promise to accept the return of any adopted animal at any time.

Lifetime Return

We offer a lifetime return policy for all animals adopted from our Organisation. Adopters may return an animal to us at any time, for any reason, without penalty. We will accept the animal and provide appropriate care and rehoming efforts. This policy ensures the welfare of all animals and supports responsible pet ownership.

Adopter Responsibilities

Adopters agree to provide a safe, caring, and suitable environment for the animal. Adopters must comply with any local laws and regulations regarding animal welfare. The Organisation may conduct follow-up checks to ensure animal wellbeing.

Fees and Payments
  • All fees paid to the Organisation, including adoption fees, surrender fees, donations, and payments for goods and services, are strictly non-refundable.

  • Fees and donations may be tax deductible. Please consult the Australian Taxation Office or a qualified tax adviser for eligibility and documentation requirements.

  • Receipts will be issued upon request for all payments.

Privacy Policy

We respect your privacy and are committed to protecting your personal information. We collect and store personal data such as names, contact details, and relevant animal information to facilitate adoptions, surrenders, volunteering, donations, and purchases. Your information will only be used for organisational purposes and will not be shared with third parties except where required by law. Data is stored securely, and access is restricted to authorised personnel. You may request access to, or correction of, your personal information at any time by contacting us.

Surrender Policy

Owners wishing to surrender an animal must contact the Organisation to arrange an assessment. Surrenders are accepted based on available resources and the animal’s welfare needs. A surrender fee may apply. Once surrendered, all rights to the animal are transferred to the Organisation, and the Organisation will make all decisions regarding care and rehoming.

Volunteer Policy
  • Volunteers must conduct themselves professionally and respectfully at all times.

  • Volunteers are expected to follow instructions from staff and comply with safety protocols.

  • Volunteers may not represent the Organisation in legal, financial, or media matters unless specifically authorised.

  • Either party may terminate the volunteer relationship at any time, with or without cause.

  • Volunteers have the right to a safe and supportive environment free from bullying and discrimination.

Goods and Services

All goods and services provided by the Organisation are subject to availability and may be withdrawn or substituted at any time. Products are provided “as is” and the Organisation makes no warranties regarding fitness for particular purpose, except as required by law. Payments for goods and services are non-refundable. Delivery times and costs will be communicated at the point of sale.

No Bullying Clause

The Organisation maintains a zero tolerance policy for bullying, harassment, or discrimination in any form. All participants must treat others with respect and dignity. Any incidents should be reported to management immediately. Breaches may result in removal from the premises, termination of adoption, volunteer, or donor status, and, where appropriate, referral to authorities.

Limitation of Responsibility

To the maximum extent permitted by law, the Organisation is not liable for any direct, indirect, incidental, or consequential damages resulting from participation, adoption, volunteering, donation, or purchase of goods and services. Animal behaviour is unpredictable and, while we take all reasonable care, we cannot guarantee outcomes. Responsibility for animal welfare rests with the adopter after adoption, except where the animal is returned under our lifetime return policy.

General Provisions
  • Amendments: The Organisation reserves the right to amend these Terms at any time. Changes will be communicated via our website or direct communication as appropriate.

  • Governing Law: These Terms are governed by the laws of Australia. Disputes will be subject to the jurisdiction of Australian courts.

  • Severability: If any part of these Terms is found invalid or unenforceable, the remainder will remain in effect.
